Yes it does, and the developer is pointing to an official rule that states if a referee decides that there is no way to win, he will allow a claimed draw. Of course, there is no human referee on these games, so they have decided to arbitrarily allow a claimed draw if you make three moves the same way. Not sure why they are so bent on not just letting time or moves max out is a mystery that they will not answer. They just continually point out the rule that cannot apply here.
You are misunderstanding the rule. The referee does not decide whether there is still a possible way to win. The referee only verifies whether the same position has occurred—or would occur—for the third time. Please read the exact wording of the rule carefully. It refers to threefold repetition of the position, not simply making the same moves three times. This topic has already been addressed in the other thread, so this duplicate thread will now be locked.
