that is what the icon indicates. it doesn't say you *do* use a program, just that you *might*. unfortunately, "they" don't just take the icon off... first, because you can never actually proove you don't use it, and second, because then there'd be no point to having the icon, because everyone would ask to have it removed, and claim they don't use programs.
programs are allowed to be used, and there is some detection system that FOD has (notably, not perfectly accurate), whether based on scanning your system for programs (i doubt they have access to that type of information), or judging by your win/loss ratio, or taking note of they way you play (whether opening moves, closing moves, or something else)... i can't really say, and neither will they.
i have heard of some people who weren't happy with their icon, so they started playing a little differently, and eventually the icon disappeared. i don't know how or why... except that it seems to be an ongoing monitoring... not something they detect once, and you're stuck with forever.
anyway, i'd bet that if a world renowned chess grandmaster came to play on FOD... within a very short time period, their account would have the icon on it, even though they wouldn't be using a program. so while you may have some issues with some people not wanting to play against you, it's just a part of FOD, and you'll have to live without it, or play a little different, and hope it disappears.
